FAQ
When should I talk to a lawyer?
You should contact a lawyer any time that you have a legal issue, or think you have a legal issue, and you are not sure as to how you should proceed. A lawyer will be able to assist you with identifying the relevant issues, time limits, and consequences. They will be able to provide guidance as to your course of action.
The police have asked me to turn myself in, or come to the station for questioning, what should I do?
How can I bail somebody out?
Bail is meant to address each person’s specific circumstances, each situation is different. Depending on the circumstances, some persons may or may not be eligible to bail somebody out.
When you bail somebody out, you become their “surety”. As a “surety”, you will become the accused person’s supervisor in the community. As their supervisor, you will have certain responsibilities.
Robert will interview, inform and prepare potential sureties, ensuring they are prepared for the bail hearing, and have the required documentation. Robert will inform you of where, and at what time, the bail hearing will take place.
Contact Robert immediately to schedule a bail hearing!
A criminal charge does not automatically stop you from being able to travel. Your ability to travel will depend on the conditions of your Recognizance of Bail, or Undertaking to a Peace Officer. Robert will review your release paperwork with you and inform you as to whether you are permitted to travel.
If I plead guilty, will I have a criminal record?
There are several sentences that can be imposed under the Criminal Code, not all sentences are available for all offences. Robert can review the details of your case with you and advise you of the potential sentences available to you if you were to enter a plea of guilty.
I have a criminal record, is there any way to apply for a pardon or remove my convictions?
Contact Robert at Kraska Law if you would like to obtain a Record Suspension (Pardon). Robert can assist you with obtaining all required documentation, and preparing the application.
I have been injured by another person (car accident, assault, etc), how long do I have to sue someone?
However, there are several exceptions to this rule, and some require action within weeks or even days of the incident. Even if you have not decided whether to pursue a claim, contacting Robert immediately will allow him to act appropriately and preserve your rights, permitting you to take the time to decide whether filing a claim is something you would like to do.
I have received a statement of claim, can I ignore it? Will it go away?
Robert will review the statement of claim, in depth, and prepare your defence in a timely fashion.
If you ignore a statement of claim, it will not go away. It is possible that you may be “noted in default”, which means that the court may consider your lack of response as an admission of the claim, and find you liable to pay the entire amount of the claim.
